Membership Terms and Conditions

Thank you for using Marcospot services and products (hereinafter referred to as “Services”). These Terms and Conditions explain the relationship between Marcospot, which provides Marcospot services, and Marcospot service members (hereinafter referred to as “Members”) or non-members who use them in relation to the use of various Marcospot services, and also contain useful information that may be helpful in your use of Marcospot services.

If you use Marcospot services or sign up as a Marcospot service member, you will be checking or agreeing to these Terms and Conditions and related operating policies, so please take a moment to carefully review them.

Enjoy various Marcospot services.
Marcospot provides various services that can add convenience to your life, such as information search, communication with other users, content provision, and product shopping, through websites and applications (applications, apps) of Marcospot domains including www.marcospot.com. You can freely use various Marcospot services through various terminals that can access the Internet, such as PCs and mobile phones, and you can easily check the specific details of each service in the guidance, notices, and Marcospot Web Customer Center (hereinafter referred to as “Customer Center”) help on each service.

Marcospot basically provides the same service to all of you.

These Terms and Conditions are basically applied to Marcospot services, but Marcospot may inevitably apply separate terms and conditions, operating policies, etc. in the process of providing various services. In addition, specific services provided by Marcospot affiliates may also be subject to unique terms and conditions, operating policies, etc. set by the relevant operating company. Please check these details on the initial screen of each service.

You can use Marcospot services more conveniently by registering as a member.

You can apply for membership after reading and agreeing to these Terms and Conditions, and Marcospot will complete the membership registration process by approving this and grant you a Marcospot service usage account (hereinafter referred to as “Account”). An account refers to a member identification unit set to manage the usage history of various services used by each member after logging into Marcospot services. Members can use more conveniently various Marcospot services through their own accounts. For more detailed information, please check the account operation policy and Marcospot membership registration method in the customer center.

Marcospot is a DAO organization consisting of supporters (leaders, supporters), travelers, and general users. They are decentralized organizations with blockchains and each role is distinct. Supporters are responsible for minting spots and managing, operating, and selling minted NFT spots. Travelers are responsible for managing, operating, and selling travel information by signing a smart contract with spoot NFT owner and travel information on minted spots. General users can read travel information and write a review. Through this review, NFT spot owners and travelers (travel information owners) can obtain mspot tokens. Marcospot can modify, delete, or designate new rules through ecosystem governance votes with the amount of mspot tokens held to maintain the mspot token ecosystem.

We will cherish the content you provide. Marcospot hopes that your posts will be delivered to other users through the Marcospot service and enrich our lives. Posts refer to various content or files consisting of symbols, letters, voices, sounds, pictures, photos, videos, links, etc. that you post on the Marcospot service for the purpose of being viewed by others or yourself.

Marcospot promises to carefully protect content that expresses your thoughts and emotions. The intellectual property rights, ownership rights, etc. of the posts you create and post naturally belong to you in accordance with the Web3 policy. However, content written in violation of the copyright law may be deleted at any time, and the legal responsibility for this lies with the person who posted the content.

Meanwhile, in order to legally provide the posts you posted through the Marcospot service, you need the right to use the content, such as storage, minting, smart contracts, and creation of secondary works (limited to translation).
By posting a post, you grant Marcospot such rights, so you must possess the necessary rights.

Marcospot will exercise the content usage rights you have granted only for the purpose of exposure within the Marcospot service, use for service promotion, service operation, improvement, and research for new service development, and search, collection, and linking on external sites.
Marcospot will do its best to provide you with more convenient and useful services through continuous research and development.

Marcospot strives to provide various means so that you can more easily manage the use or access of the content you have provided by Marcospot or other users. If management functions such as content deletion or non-disclosure are provided within the Marcospot service, you can directly control the use or access of others through these functions, and you can also request actions such as content deletion, non-disclosure, and exclusion from search results through the customer center. However, for some Marcospot services, deletion or non-disclosure may be difficult, and we ask that you check the information in the guidance, notices, and customer center help for each service.

We cherish the protection of your personal information. Marcospot collects and uses personal information only within the purpose and scope agreed upon by the member in order to provide smooth service, and safely manages it in accordance with laws related to personal information protection. You can check the efforts and other details that Marcospot makes to safely process personal information related to users and members in the personal information processing policy.

Marcospot may destroy or separately store your information after notifying you in advance via e-mail, in-service notifications, or other appropriate electronic means if you do not log in or access the service for a certain period of time. If this results in a lack of essential information for service provision, Marcospot may inevitably terminate the relevant service use agreement.

Please respect the rights of others.
Your inadvertent posting may infringe upon the copyrights of others or infringe upon their rights, such as defamation. In order to resolve this issue, Marcospot operates a posting suspension request service based on the ‘Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.’ and the ‘Copyright Act,’ etc., which includes the suspension of postings upon the request of a claimant of infringement, and the resumption of postings upon the objection of the original poster. For more detailed information and procedures, please refer to the introduction of the posting suspension request service in the customer center.

Meanwhile, using other people’s content through the Marcospot service does not mean that you own the intellectual property rights to the content. In order for you to freely use the content, the use must be within the scope permitted by the Copyright Act and other relevant laws, or you must obtain separate permission to use it from the intellectual property owner of the content, so special care is required.

Marcospot grants you the right to use the related software accompanying the Marcospot service so that you can freely use the Marcospot service. In this case, please note that your free use is permitted only within the scope that complies with the terms of use presented by Marcospot, and that such rights are non-transferable and subject to non-exclusive terms and legal notices.

Make good use of the various points provided by Marcospot.
Marcospot grants points so that you can use Marcospot services efficiently. Points refer to virtual data on the service with a certain calculation unit that Marcospot arbitrarily determines or adjusts in connection with your regular use of Marcospot services. Since points have no property value, they cannot be refunded or converted into money, but the amount of points may affect your use of Marcospot services, so please use them appropriately depending on the situation.

Marcospot may adjust some or all of the points after notifying you in advance if necessary to support efficient use of Marcospot services or improve service operation. In addition, points may expire periodically according to the period set by Marcospot, so please be careful when using Marcospot services that grant points.

There are some precautions regarding the use of the Marcospot service.
Marcospot is doing its best to ensure that you can use the Marcospot service freely and conveniently. However, in order for you to use the Marcospot service more safely and for the rights of you and others to be respected and protected in the Marcospot service, your help and cooperation are needed. In order to use the service safely and protect your rights, your posting or use of the Marcospot service may be restricted in the following cases, so we ask you to confirm and comply with this.

When registering as a member, you must not provide false information such as your email address. Please always manage the information registered in your member account so that it is accurate and up-to-date. You must not sell, transfer, rent, or provide your account as collateral to others, or allow others to use it. In addition, you must not use another person's account without permission. For more information, please refer to the account operation policy. Posts that directly and clearly pose a physical threat to others, posts that encourage or encourage self-harm or suicide, posts that reveal personal information such as personal information or private life of others, posts that continuously ostracize or harass others, posts that suggest, arrange, induce or force prostitution, and posts that directly and seriously threaten public safety may be restricted. Posts that are confirmed to have a direct risk of crime such as performing or instigating or aiding acts prohibited by relevant laws or subject to criminal punishment, posts that promote, advertise or sell goods or services prohibited from promotion, advertising or sale by relevant laws, posts that infringe upon the intellectual property rights of others or violate the rights of others such as insults, invasion of privacy or defamation may be restricted. Posts that may cause sexual shame or distorted sexual awareness in others, such as by describing provocative and explicit sexual acts; posts that may cause cruelty or disgust in others, posts that contain violent and provocative content; posts that deceive others, such as by impersonating someone other than themselves or claiming false facts; posts that repeatedly use excessive profanity or vulgar language to cause strong disgust or discomfort may be restricted. Posts that are posted by abnormally using the functions of the Marcospot service, such as by utilizing automated means; posts that do not conform to the purpose of providing each individual Marcospot service, may also be restricted as they cause inconvenience to other users in using the Marcospot service normally and further interfere with the smooth provision of Marcospot services. For detailed information on other restricted posts, please refer to the post operation policy and the terms and conditions and operation policy of each individual service. You may not attempt to register as a member of the Marcospot service or register as a member of the Marcospot service by using automated means (e.g., macro programs, robots (bots), spiders, scrapers, etc.) without the prior permission of Marcospot, attempt to log in to the Marcospot service or log in, post on the Marcospot service, communicate through the Marcospot service (e.g., email, messages, etc.), collect member IDs, posts, etc. posted on the Marcospot service, search with specific keywords in the Marcospot search service, or select (so-called “click”) specific search results from the search results, etc., or attempt to use the Marcospot service in a manner that does not conform to the purpose of providing the Marcospot service, which is based on actual use by users (people), or attempt to neutralize any of Marcospot’s technical measures to prevent such abusive behavior of the Marcospot service (e.g., continuously changing the IP to connect, bypassing or neutralizing the Captcha through external solutions, etc.). You may not insert any content or files consisting of symbols, letters, voices, sounds, pictures, photos, videos, links, etc. into the area where advertisements are posted on the Marcospot service or other areas by automated means without Marcospot’s consent. In addition, you may not copy or modify the Marcospot service or the software included therein, and you may not sell, transfer, rent, or provide them as collateral or allow others to use them. Reverse engineering, attempts to extract source code, copy, disassemble, imitate, or otherwise modify the software included in the Marcospot service is also prohibited (however, if it is open source, it is subject to its own terms and conditions). In addition, uploading viruses or other malicious codes or abnormally using service functions for the purpose of interfering with the smooth operation of the Marcospot service is also prohibited. Within the scope of these Terms and Conditions, Marcospot supports you in using the service in a stable and smooth manner by establishing a posting operation policy, terms and conditions or operation policy for each individual service, guidance, notices, and customer center help for each service. Each detailed policy includes more specific precautions for your reference, so please check them through the main text of these Terms and Conditions and links on the configuration page.

In the event that service use is inevitably restricted, reasonable procedures will be followed.
Marcospot promises to treat your content containing various information and opinions with care, but if your post violates relevant laws, these Terms and Conditions, the Posting Operation Policy, the Terms and Conditions of each individual service, or the Operation Policy, we may inevitably make it private or delete it, or refuse to post it. However, this does not mean that Marcospot has an obligation to review all content.

In addition, if you do not comply with relevant laws, these Terms and Conditions, the Account and Posting Operation Policy, the Terms and Conditions of each individual service, or the Operation Policy, Marcospot may verify the content of your related actions, and based on the results of the verification, we may restrict your use, such as by urging you to be careful about using the Marcospot service, or temporarily or permanently suspending your use of the Marcospot service in part or in whole. On the other hand, if it is difficult to expect the full maintenance of the Marcospot service agreement despite these usage restrictions, we may inevitably terminate the service agreement with you.

In the event that we must inevitably restrict your use of the service, we will adhere to the principles of gradual service restriction, except in cases where there is a clear violation of the law or infringement of the rights of others, requiring urgent risk or damage prevention. Please note that if we inevitably suspend your use of the service immediately and permanently due to a clear violation of the law, etc., all points and other benefits obtained through the use of the service will be forfeited and no separate compensation will be provided for this. Please refer to the account operation policy and the operation policy of each individual service for the conditions and details of service restriction.

Marcospot is not responsible for damages caused by Marcospot being unable to provide the service due to general errors, usage errors, operational errors, security errors, natural disasters, or other force majeure, or due to the user's intentional or negligent inability to use the service. This is to thoroughly grant independent authority for DAO and maintain an organic relationship with it. And even in cases where Marcospot assumes liability for damages, it shall not be liable for special damages, indirect damages, or other punitive damages that are normally unforeseeable or caused by special circumstances, unless there are special provisions in relevant laws.

Meanwhile, Marcospot is not responsible for any damages incurred through exchanges of opinions or transactions between you and other members or between you and non-members through the Marcospot service, or damages incurred by trusting content such as posts of others posted on the service, unless there are special circumstances.

You may terminate the Marcospot service agreement at any time.
It is unfortunate for Marcospot, but members may request termination of the Marcospot service agreement and withdraw from membership at any time, and Marcospot will process this without delay in accordance with relevant laws and regulations.

When the Marcospot service agreement is terminated, all data of the member, including all posts attached to the member account, will be deleted and cannot be restored, except in cases where Marcospot may retain the member's information in accordance with relevant laws and regulations and the personal information processing policy. However, even in this case, posts that other members have separately saved or scrapped and comments posted on public bulletin boards will not be deleted, so please be sure to delete them before requesting termination and then withdraw.

Some Marcospot services include advertisements.
When you use various Marcospot services, you may occasionally find that some individual services include advertisements. You will be responsible for any data communication charges that may arise while using Marcospot services, according to your service agreement with your telecommunications service provider, and you will also be responsible for any additional costs incurred due to viewing the included advertisements.

In order to use the Marcospot services you want, you may have to view unwanted advertisements. This contributes to the fact that we can provide various Marcospot services to you free of charge in principle, and furthermore, it provides the basis for Marcospot to invest in research and development to provide better services. This is supported by the recent practice of some third-party services emphasizing the use of advertisement-free services and providing their main services for a fee.

Marcospot will always consider and improve ways to minimize any unintentional inconvenience or burden on you.

In the event of significant operational reasons such as maintenance, replacement, or breakdown of information and communication equipment such as computers and servers, or communication disruption, all or part of the service may be unavoidably suspended.

Meanwhile, Marcospot may modify, change, or terminate all or part of the service if there is significant need for service operation or improvement. In the event that all or part of the service provided free of charge is modified, changed, or terminated, no separate compensation will be provided unless there are special provisions in relevant laws.
We will provide you with good information on important matters and listen to your valuable opinions.

Marcospot will do its best to provide you with timely information on important matters necessary for using the service. In the event of notification to members, we will notify you individually through e-mail, notifications within the service, or other appropriate electronic means, and we will post related information in notices, etc.

Marcospot will listen to your valuable opinions. You may submit opinions or suggestions for improvement related to service use through the customer center at any time, and Marcospot will do its best to inform you of the processing process and results within a reasonable scope.

We will post the terms and conditions and operating policy so that you can easily understand them and revise them after prior notice.

Marcospot may revise these Terms and Conditions, Account and Posting Operation Policy from time to time, but will revise them within the scope that does not violate relevant laws and regulations, and will notify the reason for the revision and the date of application in advance within the service.

Marcospot will take effect from the date the revised Terms and Conditions are posted.

Accordingly, we will notify you when the revised Terms and Conditions are created.

Marcospot Service is basically subject to these Terms and Conditions, but in order to reflect the unique characteristics of each individual service, separate Terms and Conditions and Operation Policy may be additionally applied. Therefore, if the separate Terms and Conditions and Operation Policy provide different provisions regarding the provision of each individual service from these Terms and Conditions, Account and Posting Operation Policy, the separate Terms and Operation Policy shall take precedence. Please check this information on the initial screen of each individual service.

Personal information handling policy information

In accordance with the Personal Information Protection Act, we inform you of the items of personal information collected from those who apply for membership in Marcospot, the purpose of collecting and using personal information, the retention and use period of personal information, the right to refuse consent, and the disadvantages of refusing consent. Please read carefully and agree.

1. Personal information collected
Users can use most Marcospot services, such as information search, in the same way as members even without registering as members. When users register to participate in the DAO organization, such as supporters (leaders, supporters), travelers, and general users, Marcospot collects the minimum amount of personal information necessary to use the service. However, supporters (leaders, supporters), travelers may collect wallet addresses.
In addition, when supporters (leaders, supporters), and travelers delegate management, the consignor and delegatee are responsible for managing personal information and wallet addresses, and Marcospot bears no responsibility in this regard.

The personal information that Marcospot collects from users at the time of membership registration is as follows. - When signing up for membership, nickname and email are required items, and in the case of supporters (leaders, supporters), travelers, simple numbers are encrypted and collected as additional items.
The personal information collected from users during the service use process is as follows.
- You can set profile information (nickname, profile picture) in member information or individual services. If you do not enter a nickname in your member information, a masked ID will be automatically entered as a nickname.
- Additional personal information may be collected only for users of the relevant service during the use of individual services, event participation, and prize application within Marcospot.

IP addresses, cookies, service use records, device information, and location information may be created and collected during the service use process. In addition, images or voices may be collected in search services using images and voices.
Specifically, 1) information about users is automatically generated during the service use process, or information entered by users is stored (collected), or 2) unique information of the user's device is safely converted to prevent the original value from being confirmed and collected. Location information may be collected during the service use process, and the location-based services provided by Marcospot are stipulated in detail in the 'Marcospot Location-based Service Terms of Use'.
The information collected in this way may or may not be personal information depending on whether it is linked to personal information.
Additional explanation on the collection of generated information
- What is an IP (Internet Protocol) address?
An IP address is online address information that an Internet service provider assigns to a user's PC or other device that accesses the Internet. There are very different views in each country on whether an IP address is personal information.
- What is a service use record?
It refers to the time and date of Marcospot access, a list of services used, and all normal or abnormal logs generated during the service use process, email addresses recorded during the process of sending and receiving emails, mobile phone numbers entered when inviting friends or sending gifts, and consultation history between Smart Store sellers and buyers (Marcospot Talk Talk and product Q&A posts). The purpose of processing some service usage records (including behavioral information) in which the information subject is identified is explained in the personal information collected, use of collected personal information, destruction of personal information, etc. stipulated in this privacy policy. This is accompanied by the provision of services, and if you refuse this, there may be restrictions on the use of the service. - What is device information?
The device information described in this privacy policy refers to all information that can be confirmed through the S/W used to operate the device, as well as the information assigned to the device during the production and sales process. It refers to the computer name assigned to the PC by the user during the OS (Windows, MAC OS, etc.) installation process, the serial number of the peripheral device installed on the PC, the unique identifier required for smartphone communication (IMEI, IMSI), AAID or IDFA, setting language and setting standard time, and the carrier code of the USIM. However, if Marcospot needs to collect a unique identifier of a device such as IMEI, Marcospot encrypts the original value in a way that it cannot be recognized before collecting it, and then collects it after removing the identifiability. - What is a cookie? A cookie is a very small text file that the website stores on the user's PC through the user's web browser when the user accesses the website. 2. Use of collected personal information
We use personal information only for the following purposes: member management of Marcospot and Marcospot-related services (including mobile web/app), service development/provision and improvement, and establishment of a safe Internet usage environment.

- Personal information is used for member management, such as confirming the intent to register, verifying age, obtaining consent from legal representatives, verifying the identity of users and legal representatives, identifying users, and confirming intent to withdraw membership.
- In addition to providing existing services such as content (including advertising), personal information is used for discovering new service elements such as demographic analysis, analyzing service visits and usage records, forming relationships between users based on personal information and interests, providing customized services based on acquaintances and interests, and improving existing services. - Personal information is used for user protection and service operation, such as restricting the use of members who violate laws and the Marcospot Terms of Use, preventing and sanctioning acts that interfere with the smooth operation of the service, including fraudulent use, preventing account theft and fraudulent transactions, delivering notices such as terms and conditions revisions, preserving records for dispute resolution, and handling complaints. - Personal information is used for identity verification, purchase and payment of fees, and delivery of products and services in accordance with the provision of paid services.
- Personal information is used for marketing and promotional purposes such as providing event information and participation opportunities, and providing advertising information.
- Personal information is used for service usage history and access frequency analysis, service usage statistics, customized service provision and advertisement posting based on service analysis and statistics, etc.
- Personal information is used to establish a service usage environment where users can use it with confidence in terms of security, privacy, and safety.
3. Retention period of personal information
In principle, the company destroys the user's personal information without delay when the user withdraws membership.

4. Right to refuse consent to collection and use of personal information
Users have the right to refuse consent to the collection and use of personal information. If you refuse consent to the collection and use of the minimum personal information collected upon membership registration, i.e., required items, it may be difficult to register as a member.
